StarGift Terms

1. Agreement and scope

These StarGift Terms ("StarGift Terms") govern your purchase and sending of StarGift digital virtual items within the MedaStaré mobile application and related supported experiences.

These StarGift Terms supplement the Terms of Use, Privacy Policy and any applicable app-store terms. If these StarGift Terms conflict with the Terms of Use specifically regarding StarGift purchases or sending, these StarGift Terms control to the extent of that conflict, except where mandatory law or the applicable app-store terms require otherwise.

By purchasing or sending a StarGift, you agree to these StarGift Terms. You must satisfy MedaStaré's general account eligibility requirements and any additional requirements shown in the app for the relevant StarGift feature.

2. What a StarGift is

A StarGift is a digital virtual item made available by MedaStaré for purchase and use inside the MedaStaré ecosystem. It allows a user to express appreciation, recognition or support for an eligible Creator through a digital interaction within the Service.

The user purchases the StarGift from MedaStaré through the billing system required or made available by the relevant app-distribution platform. The StarGift is then delivered, displayed or otherwise attributed within MedaStaré according to the product design and the recipient's eligibility.

StarGift is part of MedaStaré's digital product and Creator ecosystem. Its purpose is to enable an in-app expression of appreciation; it is not structured as a peer-to-peer money transfer between the sender and the Creator.

3. What a StarGift is not

A StarGift itself is not:

• cash, legal tender or electronic money;
• a bank deposit, payment account, wallet balance or stored-value account;
• a security, investment product or ownership interest in MedaStaré;
• a direct transfer of the sender's purchase price to the Creator;
• a wage, salary, employment bonus or other employee compensation;
• a direct gratuity or payment obligation owed by the sender to the Creator;
• a charitable donation or tax-deductible contribution; or
• a claim against any specific funds held by MedaStaré, Apple, Google, Stripe or another provider.

A sender cannot withdraw a StarGift as cash, use it as a bank balance, redeem it for money from MedaStaré, or use it as a means of payment outside the supported MedaStaré experience.

A StarGift does not require the recipient to follow, message, respond to, promote, endorse, provide content to, or provide any personal service to the sender. Purchasing a StarGift does not create an employment, agency, partnership, investment, fiduciary or personal-services relationship between the sender and the recipient.

4. Purchase and payment

StarGift is a digital product. Purchases made within an Apple-distributed or Google Play-distributed version of the MedaStaré app are processed through the billing method applicable to that storefront and transaction.

The price shown in the purchase interface at the time of confirmation is the price applicable to that transaction, subject to any taxes, currency conversion, platform charges or other amounts displayed or applied by the relevant store or payment system under its rules.

StarGift prices and denominations are variable. MedaStaré may offer different StarGift price points, denominations or promotional configurations over time and across storefronts. No StarGift denomination represents a fixed cash amount owed to a Creator, and the consumer-facing purchase price is not the Creator Payout amount.

A StarGift purchase does not guarantee any Creator Payout percentage, timing, availability or amount to the sender or recipient. Any eligible Creator Payout is determined separately under the Creator Program Terms and the then-current Creator Payout Schedule.

MedaStaré does not require you to provide complete payment-card credentials directly to the StarGift feature where the transaction is processed by Apple, Google or another authorized billing provider. The applicable provider handles the consumer payment credentials used for that transaction.

Do not complete a purchase unless you intend to send the StarGift and understand that digital delivery may occur immediately after successful purchase authorization.

5. Sending and delivery

You may send a purchased StarGift only through a supported MedaStaré flow and only to a recipient who is eligible to receive that StarGift at the time of sending.

A StarGift is associated with the recipient and transaction recorded by MedaStaré. Except where MedaStaré expressly provides a feature permitting otherwise, StarGifts may not be sold, traded, transferred outside the supported flow, pledged, assigned or used in a secondary market.

Delivery may fail or be delayed because of connectivity issues, store verification, recipient eligibility, account restrictions, technical errors, fraud review or service interruptions. If a purchase is successfully charged but the StarGift is not delivered as intended, contact support@medastare.com and include a non-sensitive transaction reference where available.

6. Creator Payouts are separate

The consumer's StarGift purchase and a Creator's potential payout are two separate legal and economic events.

The purchase price paid by a consumer is not money that the consumer transfers directly to the Creator. A Creator who receives a StarGift does not thereby acquire ownership of the consumer's payment, MedaStaré's app-store receivable, MedaStaré's revenue, or any particular funds.

An eligible Creator may separately acquire a contractual right to a Creator Payout under MedaStaré's Creator Program Terms and Creator Payout Schedule. That payout is calculated under the formula disclosed to the Creator and is paid by MedaStaré from MedaStaré's own revenue, subject to the applicable Creator Program rules.

The Creator Payout formula may take into account the actual amount MedaStaré receives after applicable app-store commissions or service fees and the Platform & Program Services Fee applicable under the Creator Program. Refunds, reversals, chargebacks, fraud findings, eligibility requirements, verification requirements, holds, reserves, taxes and other rules described in the Creator Program Terms may also affect whether and when a Creator Payout becomes payable.

The Platform & Program Services Fee is not a deduction from money already owned by the Creator. It is the commercial fee MedaStaré retains for providing, operating, maintaining and supporting the Creator monetization ecosystem, including the StarGift infrastructure, platform access and distribution, Creator discovery tools, content hosting and delivery, moderation and trust-and-safety operations, Creator and customer support, fraud/refund/reversal administration, payout operations, compliance administration, and ongoing platform development and maintenance.

Creator Payout rights belong only to an eligible Creator who has accepted the applicable Creator Program Terms. A consumer who sends a StarGift does not acquire any right to direct, control, assign or claim a Creator Payout.

7. Refunds, reversals and chargebacks

Refund eligibility and processing may depend on the app store, storefront, purchase method, applicable law and the circumstances of the transaction.

Where the applicable platform controls the refund process, refund requests must be made through that platform's available process. A recipient Creator does not have a right to demand or receive a refund of the sender's purchase price.

If a StarGift purchase is refunded, reversed, charged back, cancelled or determined to be unauthorized, MedaStaré may cancel, remove or reverse the associated StarGift record and any related Creator Program calculation to the extent permitted by applicable law and the applicable Creator Program Terms.

Nothing in these StarGift Terms limits any refund, cancellation or withdrawal right that cannot lawfully be excluded.

8. Fraud, abuse and prohibited use

You must not use StarGift to facilitate fraud, money laundering, payment abuse, sanctions evasion, artificial engagement, self-dealing, account manipulation, deceptive activity, harassment or any activity prohibited by the Terms of Use or applicable law.

Prohibited conduct includes using stolen or unauthorized payment methods, coordinating false transactions, attempting to create artificial Creator earnings, sending StarGifts through related accounts to manipulate monetization, or using StarGift to disguise a prohibited payment or transfer.

MedaStaré may block, delay, reverse, investigate or restrict a StarGift transaction or related account activity where reasonably necessary to protect users, Creators, MedaStaré, payment providers or the integrity of the Service, subject to applicable law.

StarGift purchases do not improve a user's odds, ranking, eligibility or winner-selection position in any MedArena, StarDrop, sweepstakes, contest, challenge or prize promotion unless a separate set of official rules expressly and lawfully states otherwise.

9. Availability, pricing and changes

StarGift availability, denominations, visual designs, supported Creators, purchase limits and feature presentation may vary by country, platform, storefront, account status, launch phase or product version.

MedaStaré may add, remove, reprice or change StarGift products prospectively. A change does not alter the terms of a completed purchase except where required to address a refund, reversal, fraud issue, legal requirement or technical correction.

Prices may vary by storefront, currency, local taxes, platform pricing tiers and other regional factors. The purchase interface presented before confirmation controls the consumer price for that transaction. No displayed StarGift price guarantees a particular Creator Payout, because Creator Payouts are calculated separately under the Creator Program Terms and Creator Payout Schedule using applicable Net Proceeds and program parameters.

10. Privacy and transaction data

MedaStaré may process information necessary to operate StarGift, such as account identifiers, recipient information, product or StarGift identifiers, transaction or entitlement references, purchase status, timestamps, storefront or region information, refund or reversal status, fraud signals and related support records.

Apple, Google and other authorized providers may process payment, device, account and transaction information under their own terms and privacy practices. MedaStaré's processing is described in the Privacy Policy and, where applicable, the Subprocessors disclosure.

11. App stores and third parties

Apple, Google and other distribution or payment providers may impose their own billing, refund, eligibility, territorial, tax and account rules. Those rules may affect whether a StarGift purchase can be completed, restored, refunded or reversed.

Apple or Google may process the consumer payment and may deduct commissions, service fees, taxes or other amounts before remitting proceeds to MedaStaré under MedaStaré's separate agreement with that platform. Those platform economics are separate from the consumer's ownership of the StarGift and separate from a Creator's contractual payout rights.

Stripe Connect is used for eligible Creator onboarding and payout infrastructure and is not the consumer checkout processor for an Apple In-App Purchase or Google Play Billing StarGift transaction.

12. Consumer rights

These StarGift Terms do not exclude, restrict or modify any consumer right, statutory guarantee, refund right or other protection that cannot lawfully be excluded or waived in your jurisdiction.

If local law gives you stronger rights than these StarGift Terms, those mandatory rights apply to the extent required by law.

13. Disclaimers and liability

StarGift is provided as part of the MedaStaré Service and may depend on app-store systems, network availability, recipient eligibility and third-party infrastructure. MedaStaré does not guarantee uninterrupted availability of the StarGift feature or that every Creator will remain eligible to receive StarGifts or Creator Payouts.

To the fullest extent permitted by applicable law, the disclaimers and limitations of liability in the Terms of Use apply to StarGift. Nothing in these StarGift Terms limits liability that cannot legally be limited.

14. Changes to these Terms

MedaStaré may update these StarGift Terms prospectively to reflect product, legal, platform or operational changes. Where a change is material, MedaStaré will provide notice in a manner reasonably designed to reach affected users and will obtain renewed acceptance where required by law.

The version effective at the time of a StarGift purchase governs that purchase unless mandatory law requires otherwise.

15. Governing terms and disputes

The governing-law and dispute-resolution provisions in the Terms of Use apply to these StarGift Terms, subject to mandatory consumer protections and any non-waivable rights applicable in your jurisdiction.
